Driving with Open Container a Civil, Not Criminal, Offense

A recent Massachusetts Supreme Judicial Court ruling says that driving with an open container is a civil and NOT criminal offense. This ruling changes a Massachusetts law that was first passed in 1982 as a broader crackdown on drunk driving. The intention was to promote motor vehicle safety and prevent drunk driving.
